Koh Samui Municipality to outsource waste disposal

SURAT THANI, 24 May 2016, (NNT) - The Municipality of Koh Samui has recently held a public forum to hear solutions to its waste disposal problem, which has become increasingly severe.


In attendance were government officials, members of a committee on garbage management, and members of the public affected by the problem.

The committee suggested three approaches to solving the issues, which include hiring a private company to manage garbage disposal within Koh Samui and moving garbage disposal outside of the area. The last option under consideration was to have the municipality procure waste disposal machinery and manage the problem by itself.

The forum voted to hire a private company to transport and manage waste outside of the city, concluding that this was the most environmentally friendly option available.

Early reports suggest the boat, Anthong Explorer, was returning to Koh Samui after a day trip to the Marine Park. The accident occurred at around 4pm

KOH SAMUI: An army deputy general flew into Samui yesterday to visit two UK tourists injured in the speedboat accident that killed two others earlier this week. Keukoon Innajak of Region four command promised tough action against the owner of the boat service and the driver who had "damaged the image of tourism in the country".

He presented baskets of Brands' essence and flowers to Samantha Bartlett ,36, and Sara Hammer, 31, who were injured in the disaster and recuperating at Bangkok Hospital on the island, Daily News reported.

After flying in by helicopter the deputy general said: "Koh Samui is a world renowned tourist resort. An accident like this spoils the image of the country as a tourist destination. The safety of tourists must be a priority.

"The boat involved was clearly not up to the standards required and yet it was still allowed to operate. Charges will be made against the owner of the service and the driver," he added.

it was reported that the company that ran the service is called Ang Thong Discovery 3.

PHUKET: -- The search for a British national, who disappeared after a speedboat sinking near Koh Samui on Thursday afternoon, is over, after officials reportedly recovered the man’s body yesterday.

Samui Distric chief Paiboon Omak accompanied divers, who found the body of 46-year-old Jason Robert Parnell.

“Due to heavy winds and quick, murky currents, foreign specialists joined us to help recover Mr Parnell’s body,” Mr Paiboon said. “The divers had to work in difficult conditions.”

SAMUI: -- Police announced the arrest of seven workers caught red handed packing drugs at a factory.

Bo Phut police made the arrests and took a haul of 230 kilos of Krathom into evidence. Those responsible will be charged with buying the drugs with intent to distribute reported krobkruakao. They were caught packing the leaves into foam containers for sale and admitted the charges against them 

Police on the island said it was one of the biggest busts of its kind in years.

SAMUI: -- Koh Samui police have made more arrests in a 28 million baht land transfer swindle.

Six people have now been arrested in connection with the falsification of documents concerning the transfer of two pieces of land. The trick involved false legal documents trying to sell the land for a third of its real price reported Manager Online.

Latest arrests on warrants were of two women, Mathurada Deemeesri and Bupha Thongleua. They have been initially charged with receiving stolen goods as investigations continue to round up several other gang members. Four others were arrested earlier for the case that dates back to March 2015,

Arrest warrants have been issued for two further people this week. A total of nine are believed to be behind the scam.

Koh Tao murders appeal reveals shocking new evidence suggesting unfair trial and wrongful convictions

KOH SAMUI: -- According to an article written by a key member of the defence team of Zaw Lin and Wai Phyo, the 22 year old Burmese migrant workers convicted of the murders of Hanna Witheridge and David Miller in September 2014, lacerations to the female victim were caused by the Thai autopsy and not rape.
 
This revelation came to light when the article, written by Nad Bergman, was published by the Thai Justice website. It says “The incision discovered inside suspects koh tao murdersthe victims vagina, was determined by the British autopsy to have been caused by the Thai autopsy, not as a result of sexual assault”.

The trial for the murders of Hannah Witheridge and David miller and the rape of Hannah Witheridge gained much public interest and was dogged by criticism of both the investigation and the prosecution. The handling and lack of chain of custody of the DNA samples was widely criticized, the missing wine bottle and cigarette butts as well as the female victims clothes, all said to have carried vital DNA evidence, were missing entirely from the trial. Allegations of the torture of the two accused, who initially confessed to the crimes but later retracted their confessions have been causing grave concerns among human rights activists, the friends and family of the accused and their supporters around the globe. Reports of the local mafia intimidating the court translators made the news early on in the trial, the lack of CCTV footage of the crimes linking the two men to anywhere other than the crowded beach has caused grave concern and of course without a single piece of CCTV footage, or a single witness to the actual crime, it is hard to believe that any court could find the two men guilty without reasonable doubt and sentence them to death.

The two men who have no previous criminal history, motive for the rape and murders, and whose DNA was never found on the murder weapon now face yet another year on death row as they wait for their appeal to be considered by the same Region 8 team who handed them both the death penalty for rape and double murder to consider the 198 page appeal document submitted a few days ago by the defence team.

According to the newly published report the appeal questions why the police claimed that DNA samples from the crime scene were sent to Singapore where it was determined the suspects were Asian but later stated this had been revealed in a Thai lab and the samples had in fact never been sent to Singapore.

It goes on to question why –

The suspects were arrested on unrelated charges before being questioned about the murders without an attorney present and their statements were entered as part of the prosecution’s evidence. This is a violation of Thai law and grounds for dismissal of the case.

Both DNA samples taken from the defendants were done without consent and before they were informed of the murder charges.

During the interrogation a hostile interpreter was appointed by the police who cannot read written Thai. The defendants were never properly advised of the murder charges nor their rights under Thai law.

Both accused testified they were stripped naked during the interrogation and physically assaulted including, but no limited to, being punched, genital torture, being kicked and having bags placed over their head. Wounds and bruises of these accusations were present and confirmed by no less than three doctors with regards to one of the defendants.

Fingerprints from the accused on the mobile phone that belonged to one of the victims were never produced, this raises the question of who they actually belonged to. There was absolutely no forensic evidence presented by the prosecution connecting the mobile phone to the accused.

The prosecution speculated that the motive for the attack was the accused being aroused by both victims having sexual intercourse on the beach. There is no evidence to suggest this ever took place and the small abrasion found in the victims vagina could easily have been a result of consensual sex with a third party.

The autopsy was unable to determine if intercourse had taken place before or after death. It is impossible for the prosecution to determine if any rape had taken place.

The Thai autopsy was no more than a four page summary by the doctor. The legally required autopsy file documenting the procedure with step-by-step photos and point to point analysis was never presented. The British autopsy however was.

The incision discovered inside the victim’s vagina was determined by the British autopsy to have been caused during the Thai autopsy, not as a result of sexual attack.

DNA files presented had the accused names on them, rather than a proper file reference number. This is not possible without pre-knowledge of whose DNA the sample being tested belonged to.

The DNA on the murder weapon matched neither of the accused. The police originally claimed the murder weapon had no DNA evidence.

The DNA tests presented by the prosecution were not provided with the necessary supportive documents showing multiple procedures required to meet ISO 17025 standards required in DNA testing. Including the chain of custody, method of testing, graph generation and analysis report.

The police claimed a 100% DNA match with the accused from samples taken from the victim’s body this is scientifically impossible in any forensic lab anywhere in the world.

Other questionable evidence not raised by the appeal includes CCTV footage of the only pier with boats leaving the island immediately after the murders not being examined and blonde hairs found in the victim’s hand not being examined.
The defence team believe that the prosecutions requirement to prove guilt beyond a shadow of a doubt has clearly not been met.

While the families, friends and supporters of the now convicted men have always questioned how it was possible with the evidence presented in court to prove beyond reasonable doubt that the men were guilty of the crimes, the appeal documents now makes it abundantly clear that not only was it not proved beyond reasonable doubt, vital evidence that would normally lead to a conviction was missing entirely.

With this in mind the guilty verdict and subsequent death penalty is unfathomable. There is no evidence to suggest the female victim was raped, or that either men caused the death of both Hannah and David, let alone both managing to kill them and both being convicted of the same murders. The newly available information from the appeal also brings into question how it was possible, in light of the new revelations, to lose the trial in the first place.

With such lack of evidence, compliance with DNA testing standards, police investigation procedures and even Thai law, one must also question why, on the day of the verdict Mr Michael Miller, brother of the victim, very publically announced that having listened very carefully to the evidence he and his family were satisfied the right men had been convicted. It seems that the Miller family are one of only a handful of people who are convinced. Mr Miller, in his post-verdict statement went on to comment that both men had showed no remorse. Perhaps this was due to neither men feeling remorse for a crime they did not commit and who stood to lose their lives because of it. Both of the now convicted men have relayed their sorrow for the victims and their families and Zaw Lin has vowed that should he be released he would like to support the families of the victims of the crime he is also a victim of. Mr Michael Miller also asked the boys supporters to accept the verdict of the court.

In light of the newly published appeal evidence, it has become very obvious as to why they were insulted by his request. One has to also question that why the Miller family are not as determined to ensure that true justice is found for David, when so much doubt surrounds this conviction. “Wrongful convictions and scapegoating are common place in this part of the world” said one supporter, who asked to remain anonymous, “perhaps the Millers are unaware this is not the UK and you cannot trust the verdict of the courts, this is a 3rd world country where mistakes are made far more often than in the west. Corruption is rife here” she went on to say “I am not sure which trial they were listening carefully too, but I was present during the Koh Tao murder trial and I was far more confused when I left on the last day than I was went I went in on day one”.

Supporters of the two convicted men around the world continue to fight for the truth, a new and fair trial, and some answer to the question of who did commit these crimes. Would finding the truth prevent another family having to cope with such un unimaginable tragedy and were the other 6 suspicious deaths of foreigners on Koh Tao in some way connected and were the other 5 of Asians part of some macabre dark secret kept by the residents of Koh Tao.

There will always be speculation over the convictions of Zaw Lin and Wai Phyo, two young men whose only dream in life was being able to provide for their families. These new revelations will do nothing but fuel the fire of unfair trials, corruption, mafia activity on the islands, cover-ups and scapegoating. Should the boys win the appeal and be freed, questions will then be raised over the investigations, trails and convictions of others who profess their innocence and the shadow of international suspicion will continue to fall on a small island in the gulf of Thailand that has proved itself in the light of the international media to be far darker than it appears!

KOH SAMUI: -- A Korean family of five who believed their GPS ended up stranded in the hills of Koh Samui last night.

Fortunately quick action by police located the hapless family stuck on the hillside in the dark bringing them back to safety reported Daily News.

The visitors raised their wands in thankful "wais" praising the quick actions of authorities and saying they would come back to Samui again.

Sun Ja Kang, 50, one of the five Koreans said that they had rented their Chevrolet Captiva and gone out for a drive. They had followed their GPS but ended up in a deserted area off the road on the Pom Hill in the Mae Nam area on the northern part of the island. As it grew dark and in pouring rain they continued on dirt roads until they were stuck with very little petrol left.

They called the rental company for help who contacted local police who saved the day. The Koreans were found nearly three kilometers from the main hill road.

The family were very grateful to the rescue team praising the kind spirit of the Thais saying that if they get another opportunity they will come back to visit Koh Samui again.

SAMUI: -- Officials are investigating the death of a man who was being held in custody at the Bo Phut Police Station in Koh Samui yesterday.

“Kosin Tongjutha, 44, originally from Nothanburi Province, was found dead in his jail cell with no signs of a struggle,” said Lt Col Denduang Tongsisuk of the Bo Phut Police.

“A urine test has confirmed the presence of drugs in his system. He seemed to have been dead for about five hours before his body was discovered.”

KOH SAMUI: -- Banana IT in Koh Samui have ruined the holiday of a 70 year old British woman who was on the island to celebrate her milestone Birthday with her daughter.


During her stay the Mrs Connell decided to buy a new phone, as hers had broken, and went to Banana IT to purchase a 28,875 baht 64Gb Rose Gold iPhone.
 
However the pensioners delight at her new purchase turned to disappointment when it turned out the phone did not work, but thinking Banana IT (Comseven, a publically listed company) was a reputable company she and her daughter assumed they could return the phone to the shop and get a replacement or refund.
 
However when they arrived at Banana IT they told by a very rude assistant that the faulty phone could be neither be refunded or replaced and tried to force the now very upset mother to sign a disclaimer.
 
Disgusted with the service and upset to have invested in a worthless phone Mrs Connell and her daughter approached the tourist police for advice. The tourist police suggested that the matter be dealt with by the Samui Provincial Tourist Court before laughing and joking with the shop assistant, who had laughed in Mrs Connells face, before giving the shop assistant a ride home.

Mrs Connell has been left shaken and upset by her experience with Banana IT. “I came to the island of Koh Samui to enjoy my 70th Birthday with my daughter” she told the Samui Times, “all I wanted to do was buy a new phone for my trip”.

“I was having a wonderful time but now I feel completely violated and having to go to the police over a matter that should have been easily dealt with ‘in store’ was very upsetting, and now I am facing a court case, it’s completely ruined my impressions of Koh Samui.”

The phone, that was purchased less than 48 hours ago, should have been replaced under the 7 days returns policy that Banana IT are blatantly disregarding.
 
“I can’t believe this has happened” said Mrs Connells daughter, “my Mum came here for her 70th birthday, not to take abuse from nasty shop assistants or be forced to spend time with the tourist police”
 
She continued “having to face a court case over a phone that should simply have been refunded or replaced is ridiculous, now she is £500 out of pocket and has had a really upsetting experience, I am so cross, it really is a disgrace”.

The Samui Times tried to contact Banana IT but could not reach them by phone, it seems their phones are either also malfunctioning or maybe their customers service by phone is almost as bad as their over the counter skills!

KOH SAMUI: A Samui jetski operator did his bit for the good of humanity....and the Thai tourism industry on Friday.

Riding around the Mae Nam area on his motorcycle he happened to see a wallet in the road. It contained dollars and baht to the tune of 16,000 baht along with a driving licence and credit card and clearly belonged to a tourist.

Nikhom Phimthep, 35, took it straight to Mae Nam police who managed to locate the very happy owner - a Kazakhstan tourist called Alisodar Sino, 31.

It was all broad grins as owner and valuables were reunited - yet another happy tourist in the Land of Smiles.

As Nikhom said: "It is not nice to lose stuff. If I ever did I hope someone would hand it in too."

SAMUI: Police seized an illegal stockpile of fireworks estimated to be worth two million baht from a shophouse in Koh Samui this week.

Police raided the property on Taweerat Road in the Bo Phut district at 5pm, after a tip off from local officials.

Bo Phut Police Lt Denduang Tongsisuk said the owner, named only as Mr Off, had locked the front and back doors and refused to talk with police.

KOH SAMUI:-- A crystal meth dealer and his customer were arrested in Koh Samui Thursday after reports that that someone was selling drugs to teenagers in the Mae Nam area.
 
Somsak (Tor) Phromcharoen, 35, was caught at his rented room with six bags of ice weighing 50 grams. Police confiscated two digital scales and a mobile phone, reported Channel 3.
 
Also in the room was a woman called Supitchasiri who looked suspicious.
 
The 45 year old was a customer and had six packets of ice in her bag. She admitted buying the drugs and was going to take them during the Euro football championships, she said.
 
Somsak admitted that he had come out of prison six months ago and had no work so decided to sell drugs. While police were processing him several calls came in on his mobile phone from potential customers.

KOH SAMUI: A huge mountain of accumulated garbage is threatening the image and tourism potential of Koh Samui and the problem is steadily worsening as the only incinerator of the municipality has been inoperational for about eight years.

Mr Anond Wathayanont, a member of the development committee of Koh Samui municipality, said that the undisposed garbage, estimated at about 250,000 tonnes had been left abandoned around the malfunctioned incinerator and had piled up as high as a three-storey building.

Moreover, about 150 tonnes of garbage are generated each day from households and tourism-related establishments, adding up to the garbage which are not disposed of, he added and blamed the rapid expansion of tourism business for contributing to increasing garbage problem.
The municipality has tried to address the problem by hiring a private sector to dispose of the garbage but has to terminate the contract later on because of poor performance, said Mr Anond, adding that the municipality has sought financial help from the government to fix the incinerator but help is yet to come.

As an alternative while the incinerator remains out of order, the municipality has launched publicity campaign urging households and business operators to separate garbage into garbage which can be recycled and garbage which needs to be disposed of.

SAMUI: -- Channel Three TV reporters went to see for themselves what Thai public toilets were like after the issue was raised on social media causing much public comment.

They went to some loos in a public place that tourists frequent near the beach resort of Chaweng in Koh Samui.

And what they found would be unlikely to reassure the Thai public or visitors - the place was in an awful state and not just smelly either.

They found condoms, syringes and drug taking paraphernalia saying that the place was a danger especially to women and female foreign tourists.

A spokesman for the Samui local authority who have responsibility for the toilets at this site said they were aware of the problems and that the loo's location made it difficult to monitor. It had become a hangout for teenagers up to no good at night.

The doors had been locked at night but the locks had been broken and equipment and fittings inside had been damaged and removed.

There was some good news, however - a new block is planned in a better location nearby.

Comment online was loud and clear - Thai people complained it was not just this location but Thai public toilets are a national disgrace.

One person called Krittaput Beer commenting about the Samui toilets in question said: "I went in there once - never again. I go home now if I need to use the loo".

OSLO: -- A 34-year-old businessman from Sweden but living in Oslo faces trial in Norway for having had a sexual relation over several years with a Thai girl who was 13 years old when he first had sex with her.

According to the prosecution, he first met the girl when he bought her out of a go-go bar in Koh Samui in 2008. She didn’t speak a word of English, but he was told she was 16 years old. The sexual relationship continued over the coming years at least until 2011. At the age of 14 she became pregnant with his child. Since she gave birth to his child he has sent her around NOK 1,000 (USD 120) a month in child support.

According to the Norwegian state media, NRK, the man’s home was searched not because of the sexual offence but because he was involved in a drug case. Police found photographic sexual material including photos of the girl in Thailand in his computer and in cooperation with police in Thailand, Norwegian investigators found the girl and determined her age.

“This is a serious case,” says state prosecutor Asbjørg Lykkjen to Norwegian Broadcasting (NRK) on Tuesday.

The trial will begin in an Oslo court this fall. He faces a 10-year-jail term if convicted.

The man has allegedly denied criminal liability.

Halldis Winje, the Norwegian attorney appointed to represent the girl, told NRK that In addition to the criminal charges filed against the man, he is seeking compensation on behalf of the girl and her family.

Hanging wires: beautification of Samui begins

SAMUI: -- Work has begun in earnest to bury the unsightly wires and cables that blight tourist spots on the holiday island of Koh Samui.

Workers from the Electrical Generating Authority of Thailand (EGAT) working in conjunction with ten other cable companies have started on the work in the Chaweng beach road area of the island, reported Thairath.

They hope to eventually bury some 3.1 kilometers of wires in the area at a cost of 380 million baht. The Chaweng work should be completed by the end of 2018 with some 1.3 kilometers of work to also be done in other areas of Samui.

Chaweng was given the priority because it is a high profile tourist area.

The start of work follows a lot of comment recently about the problem of ugly and possibly dangerous electrical wires and cables hanging from EGAT posts. The issue even came to the attention of Bill Gates who commented online about the issue facing Thailand and other countries.

The work has actually been in the pipeline for three years but has been hurried along recently after senior government figures got involved.

Panumat Limsuwan of EGAT said that the work is a joint operation of the electrical authority and ten other companies. The first stage, he said, is to cut out wires and cables that are no longer being used then to bundle up those that are used in a neat way.

Authorities are currently offering the work of burying the wires and cables out to tender.

KOH SAMUI: -- Photos circulating on line of dirty and unsafe toilets at Pru Chaweng Park in Koh Samui have sparked enough public outrage that officials are considering moving the facilities.

Images of used needles, condoms and faeces went viral on July 5, after a user posted them on Facebook. The ten-toilet public restroom is located in a public park and falls under the purview of the Koh Samui Municipality.

The park is a popular destination for families and has a large field used for festivals and ceremonies.

Koh Samui Deputy Mayor Muensil Poonsawat said the municipality was aware of the situation, but that the blame rests with "teenagers" for vandalizing the facility at night.

KOH SAMUI: An Indonesian man has been detained by police after picking up a suitcase stuffed with 3 kilograms of cocaine at Samui International Airport on Thursday (July 14).

The suspect, named by police as Djemmy Petrus Mokodompit, 48, had arrived on Koh Samui a week earlier, on July 8, on a Bangkok Airways flight from Singapore.

The unaccompanied suitcase arrived at Samui airport on July 14 on a separate flight from Singapore.
Samui Airport Customs officials’ suspicions were raised when they X-rayed the suitcase, which appeared to have something lining the insides.

Police then detained Mr Mokodompit when he picked up the suitcase, which investigators cut open to reveal layers of resin and plastic concealing the stash of cocaine, said Samui District chief Paiboon Omak.

Human rights officials oversee Ko Samui prison

SURAT THANI, 18 July 2016 (NNT) – A human rights commissioner has visited Ko Samui District Prison to survey the living quality of inmates and the prison's internal management system, urging changes to prison protocols.


The National Human Rights Commissioner Chatchai Suttiklom, the President of Human Rights in Judicial Process Subcommittee, has led a team to visit Ko Samui District Prison in Surat Thani to oversee the living quality of inmates and officials' internal management policy.

The prison currently houses 702 inmates, significantly exceeding the maximum capacity of the prison. The overcrowded prison complex was only designed to hold 452 inmates. 70 percent of the inmates are charged with offences related to narcotics, according to the prison director Pornthip Rattanachaiyarit.

On this occasion, the human rights commissioner advised the prison director to incorporate communities outside of the prison into a development network for prisoners and inmates, and to ensure all inmates are treated with basic human rights principles.

The commissioner has also urged the prison director to implement the policies for changes in the correction system as guidelines for the management of inmates.
